1. Scope and Acceptance
This User Agreement (“Agreement”) applies to any mobile application, website, software, content, or digital service that links to this Agreement (together, the “Services”). By downloading, accessing, or using a Service, you agree to this Agreement. If you do not agree, do not use the Services.
2. Eligibility
You must be legally able to accept this Agreement where you live. If applicable law requires permission from a parent or legal guardian, you may use the Services only with that permission. You are responsible for following age ratings and other local requirements that apply to the content or feature you access.
3. Accounts and Access
Some Services or features may require an account. Information you provide should be current and accurate. You are responsible for activity under your account and for protecting your sign-in credentials. Notify us if you reasonably believe your account has been accessed without permission.
If a third-party sign-in option is available, your use of that option is also subject to the provider’s terms. Losing access to the third-party account may affect your access to the Service.
4. Limited License
Subject to this Agreement, we grant you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to install and use the applicable Service on a supported device for private, non-commercial purposes.
The Services are licensed, not sold. No ownership interest in software, audiovisual content, trademarks, designs, data, or other materials is transferred to you.
5. Service Features and Availability
The Services may provide short-form entertainment, content discovery, playback, account functions, recommendations, advertising, purchases, subscriptions, or other features. Available content and features may vary by app, version, device, account, and region.
We may add, modify, suspend, or discontinue content or features when reasonably necessary for operational, licensing, technical, security, or legal reasons. We do not promise that every title, feature, device version, or older software release will remain available.
6. Software Installation and Updates
Download Services only from an official website, authorized app store, or another source we identify. Versions obtained from unauthorized sources may be modified, unsafe, or unable to receive support.
A Service may download or require updates to maintain compatibility, security, content access, or features. Older versions may stop working after an update. You may stop using a Service and uninstall it at any time, subject to any separate purchase or subscription terms.
7. Acceptable Use
You agree not to:
- use the Services unlawfully or in a way that violates another person’s rights;
- copy, record, redistribute, sell, publicly display, or commercially exploit content unless the Service or applicable law expressly permits it;
- circumvent access controls, territorial restrictions, security features, payment controls, or usage limits;
- reverse engineer, decompile, modify, or create derivative works from the Services except where applicable law does not allow that restriction;
- use bots, scripts, scraping tools, automated requests, malicious code, or other methods that interfere with the Services or place an unreasonable load on them;
- attempt unauthorized access to accounts, systems, networks, source code, or data;
- impersonate another person, misrepresent your identity, or use the Services for fraud;
- upload or transmit unlawful, infringing, abusive, deceptive, or harmful material; or
- remove ownership notices or misuse names, logos, trademarks, or other brand elements.
8. Content and Intellectual Property
The Services and their software, interfaces, graphics, trademarks, music, text, videos, and other content are owned by us or our licensors and are protected by applicable intellectual property laws. Except for the limited license above, all rights are reserved.
Content may be available only for a limited period or in certain regions because of licensing arrangements. You may not retain or use content outside the viewing or access methods provided by the Service unless applicable law permits it.
9. User Submissions and Feedback
If a Service allows you to submit reviews, messages, profile material, or other content, you remain responsible for the submission and must have the rights necessary to provide it. You must not submit content that violates this Agreement or another person’s rights.
If you send product suggestions or feedback, we may use them to evaluate or improve the Services without an obligation to compensate you. This does not give us ownership of personal information, which remains subject to the Privacy Policy.
10. Purchases, Subscriptions, and Digital Items
Some Services may offer paid content, subscriptions, access passes, credits, or other digital items. Before a transaction, the applicable Service or store should display the price, billing period, included access, and any renewal terms.
Transactions may be processed by an app store or payment provider and are also subject to that provider’s rules. Manage or cancel a subscription through the account or store used for the purchase. Refund eligibility is determined by the applicable store rules and mandatory law; this Agreement does not create a separate refund promise.
Digital items are licensed for use within the applicable Service, have no cash value unless required by law, and may not be transferred or sold outside features expressly provided by the Service.
11. Advertising and Third-Party Services
A Service may display advertising or provide links and integrations involving third parties. Third parties are responsible for their own content, products, terms, transactions, and privacy practices. The appearance of a link or advertisement does not mean we endorse every statement made by the third party.
12. Privacy
Our Privacy Policy explains how information may be handled across the Services. Review it together with this Agreement and any permission or purchase information shown in the relevant Service.
13. Enforcement, Suspension, and Termination
We may investigate suspected misuse and take proportionate action, including limiting a feature, removing unlawful or infringing material, suspending access, or terminating an account, when we reasonably believe this Agreement has been violated or action is needed to address fraud, security, legal risk, or harm to users or the Services.
Where appropriate and legally required, we may provide notice or an opportunity to resolve an issue. You may stop using the Services at any time. Provisions that by their nature should continue after termination, including ownership, disclaimers, liability limits, and dispute terms, remain in effect.
14. Disclaimers
We work to provide useful and reliable Services, but availability may be affected by maintenance, network conditions, device compatibility, licensing changes, third-party services, or events outside reasonable control. To the extent permitted by law, the Services are provided on an “as available” basis without promises that they will be uninterrupted, error-free, secure, or suitable for every purpose.
Nothing in this Agreement excludes a warranty, consumer right, or other protection that cannot legally be excluded.
15. Limitation of Liability
To the extent permitted by applicable law, we and our service providers will not be liable for indirect, incidental, special, exemplary, or consequential losses arising from or related to the Services. Any limitation applies only to the extent legally permitted and does not limit liability that cannot be excluded or restricted under applicable law.
16. Events Outside Reasonable Control
We are not responsible for a delay or failure caused by events outside reasonable control, such as natural disasters, widespread network or infrastructure failures, government actions, labor disruptions, conflict, or failures of essential third-party platforms. We will take reasonable steps to restore affected Services where practical.
17. Changes to This Agreement
We may update this Agreement to reflect changes to the Services, business practices, or legal requirements. The “Last updated” date identifies the current version. When a change is material, we may provide additional notice through the relevant Service or website. If you do not agree to an updated Agreement, stop using the affected Services.
18. Applicable Law and Disputes
This Agreement is interpreted under applicable law and does not waive consumer rights or protections that cannot legally be waived in your country or region. Before starting formal proceedings, you may contact us so the parties can try to resolve the issue informally.
19. General Terms
If a provision of this Agreement is found unenforceable, the remaining provisions continue to apply. A failure to enforce a provision is not a waiver. You may not transfer this Agreement or your rights under it without permission, except where applicable law provides otherwise. We may transfer our rights and obligations as part of a business reorganization or transfer of the relevant Service.
